本文剖析生成式AI创作内容在客体资格认定中的"独创性"适配困境、权利归属中的多方主体利益冲突及侵权责任划分中的权责模糊问题,认为现有制度对AI生成内容的规制存在标准缺失与执行障碍,需通过构建分层化客体认定标准、确立贡献度导向的权利归属规则、完善全链条侵权监管机制予以回应。研究可为AI创作内容的著作权保护提供制度设计参考,实现技术创新与权利保障的平衡。
This article analyzes the predicament of “originality” adaptation in the object qualification determination
of generative AI-generated content, the conflict of interests among multiple subjects in the rights ownership, and the
ambiguity of rights and responsibilities in the division of infringement liability. It holds that the current system’s
regulation of AI-generated content has standard deficiencies and implementation obstacles. It is necessary to respond
by establishing hierarchical object identification standards, setting contribution-oriented rights ownership rules, and
improving the full-chain infringement supervision mechanism. Research can offer institutional design references for
AI-generated content’s copyright protection, balancing technological innovation and rights protection.
