摘要

人工智能算法的快速发展对我国专利保护体系提出了严峻挑战,突出表现为可专利性界定模糊、审查复杂、侵权认定困难等。本文深入探讨了这些挑战,并提出了多维度完善路径 :明确算法技术贡献的专利标准、优化审查流程以提升专业性、健全司法保护机制以高效维权、加强国际合作以接轨全球实践以及鼓励创新主体强化自身专利布局。这些举措旨在构建一套更适应 AI 时代特点的专利制度,从而有效激励算法创新,推动我国人工智能产业的健康发展。

Abstract

The rapid development of artificial intelligence algorithms poses significant challenges to China’s patent protection system, primarily manifested in ambiguous patentability definitions, complex examination processes, and difficulties in infringement identification. This paper thoroughly examines these challenges and proposes multidimensional improvement pathways: clarifying patent standards for algorithmic technological contributions, optimizing examination procedures to enhance professionalism, strengthening judicial protection mechanisms for efficient rights enforcement, promoting international cooperation to align with global practices, and encouraging innovators to bolster their patent portfolios. These measures aim to establish a patent system better suited to the characteristics of the AI era, thereby effectively incentivizing algorithmic innovation and fostering the healthy development of China’s artificial intelligence industry.
