Abstract

RCEP took effect in China in 2022, and China is negotiating CPTPP accession. The two Asia-Pacific FTAs establish TRIPS-plus border IP rules. This paper compares their border measures for infringing digital carrier goods and the challenges to China’s customs supervision. It contrasts their differences in enforcement triggers, coverage and goods disposal, analyzes defects in China’s Customs IP Protection Regulations, and puts forward targeted improvements to meet high-standard international rules and back up CPTPP accession negotiations.
